Grand Jury indicts 2 men for sex crimes

The Estill County Grand Jury returned indictments last week for six individuals including two men who are charged with sex crimes.
Robert F. Warner, 76, of Spout Springs Road, is charged with six counts of first-degree sexual abuse of a victim under 12 years of age and one count of first-degree sodomy with a victim under 12 years old.
According to the indictment, between the years of 1997 and 2004, Warner committed the act of sodomy. The counts of sexual abuse occurred between different time periods for each victim. The indictments states that Warner sexually abused victims during the following time periods: between 2004 and 2005, between 1992 and 2000, between 1996 and 2003, between 1997 and 2004 and during the summer of 1976.
Warner was arrested in April after an investigation into drug activity on Spout Springs Road.
Kentucky State Police (KSP) Trooper David Fugate issued the uniform citation that states that Warner engaged in sexual intercourse with four victims over the course of several years.
Fugate reported that Warner confessed to subjecting the juvenile victims to sexual contact by “forcible compulsion.”
Forcible compulsion is defined, in terms of sexual offenses, as sexual abuse by physical force or threat.
He then admitted to be “being sexually aroused while he was touching the victims.” Warner also said he forced his victims to touch him in his “private areas.”
Warner’s son, Charles Warner, 54, of Spout Springs, was arrested in April also. The grand jury returned an indictment for his last week. He is charged with cultivating marijuana (five plants or more, first offense), possession of a firearm by a convicted felon, first-degree possession of a controlled substance (first offense) and possession of prescription controlled substance no in the proper container.
The indictment states that on April 22, Charles Warner had 44 marijuana plants in three small trays inside his house. He also had a Belknap .22-caliber long rifle and a Shinna 20-guage shotgun. Police found two small silver pill containers that had 52 10-millligram oxycodone in them.
In addition to Robert Warner, another man was indicted for sex crimes that occurred in Estill County.
Darold Patton, 35, of Richmond, is charged with first-degree rape and as a second-degree persistent felony offender. According to the indictment the rape occurred in Estill County on or around July 16, 2012.
Irvine Police Department Chief Brad Smyth reported Tuesday that Patton was served his indictments papers by the Richmond Police Department.
Patton is currently incarcerated in Madison County on charges of felony assault.
IPD Officer Michael Gross worked the case in Estill County.
The grand jury also returned indictments for:
•Christopher Norton, 24, of Pea Ridge Road, is charged with receiving stolen property under $10,000. Norton had in his possession four gamecocks worth $1,250 on March 13. The birds were reported stolen by Donald Mullins.
•Eric DeWayne Cox, 36, of Edgewater Drive, is charged with two counts of first-degree trafficking in a controlled substance (first offense), first-degree possession of a controlled substance and buying or possession drug paraphernalia. According to the indictment, on May 16 Cox sold three 30-milligram oxycodone pills to a confidential informant for $40 each. He had in his possession 12.5 30-milligram oxycodone pills.
A search warrant to search his home lead police to find a “needle, bowls and containers for shooting up.”
•Aubree Duechle, 31, of Stump Road, is charged with making a false statement to receive benefits over $100. During November 2009 through January 2013, Duechle did not report income she earned from Stanton Nursing Center and Extended Care Nursing. During this time she was receiving SNAP benefits resulting in an overpayment of $13,243.
